MINUTES OF THE REGULAR MEETING OF THE PLANNING COMMISSION OF THE CITY OF NORTH MUSKEGON December 13, 2000 The meeting was called to order at 7:00 p.m. COMMISSIONERS PRESENT Roger Buter, Vern Molitor, Donna Spytma, Steven Szatkowski, Harry Wierenga (arrived 7:10 p.m.), Kenneth Winter, and Chris Witham.(7) COMMISSIONERS ABSENT Tracy Sodini and Roy Walters.(2) 2000-36 APPROVAL OF MINUTES - NOVEMBER 29, 2000 Witham moved, Winter seconded, to approve the minutes of November 29, 2000 as presented. MOTION CARRIED. 2000-37 CITIZEN COMMENTS Dale Marshall, 602 Pinewood, stated that the day care at 607 Pinewood was operating until all hours of the night. Ms. Dawn Dick has indicated to the neighbors that she would operate her business from 7:00 a.m. to 6:00 p.m. Letters were presented from Charles Lyons, 1625 Moulton and Vicki Langdon, 614 Pinewood Road, expressing their concern. Chairman Spytma stated that she would have the City Manager write a letter to Ms. Dick stating that complaints had been received regarding the hours that she is operating her day care. 2000-38 DISCUSSION OF ZONING ORDINANCES The following items were discussed: Section 3.27(c) Change to not more than (30) days. Ask consultant about utility trailers. Section 3.28(a) Change front yard to front set back. 3.29(a) Something less restrictive but enforceable? 3.30 (c) change front yard to front setback. (D) Change zoning administrator to building inspector. 3.31(b1) By zoning administrator or building inspector? 3.32 Change to 365 days from start of construction. Ask consultant about extensions. 3.33 Ask consultant about lot splits. After structure add, "intended for occupancy". 3.34(c) Change front yard to front setback. 3.34 Change lighting to be in accordance with this ordinance. MOTION CARRIED. 2000-35 DISCUSSION OF THE PROPOSED ZONING ORDINANCE CHANGES The following items were discussed: Section 3.17 Ask consultant if there is a more restrictive ordinance. Section 3.19 (a) Change 12 feet to 8 feet and add pool and irrigation units. 3.21 (a) Why? Take out "certain", change title to "Projections into Setback Areas" 3.24 Take out (f). (G) change 20 feet by 30 feet to standard building requirements in R1 districts. Ask consultant about (h). Why can’t we stop after (c). 3.26 Make it a positive statement. (A) No satellites in front yard. (D) remove "for safety purposes". Ask consultant about (f). Meeting adjourned at 8:20 p.m. ___________________________________ Ann Marie Cummings, CMC City Clerk MINUTES OF THE SPECIAL MEETING OF THE PLANNING COMMISSION OF THE CITY OF NORTH MUSKEGON November 15, 2000 The meeting was called to order at 6:00 p.m. COMMISSIONERS PRESENT Tracy Sodini, Donna Spytma, Roy Walters, Kenneth Winter, and Chris Witham.(5) COMMISSIONERS ABSENT Roger Buter, Vern Molitor, Steven Szatkowski, and Harry Wierenga.(4) 2000-32 DISCUSSION OF THE PROPOSED ZONING ORDINANCE CHANGES The following items were discussed: Section 3.6 Does our City Code address moving buildings through the City? Section 3.7 Ask zoning official what "typical" is. Section 3.9 Is electrical substations included? Section 3.10b Can we not allow fences in the front setbacks? Can lake lots be treated differently? Section 3.10f Change 25 feet to 20 feet Section 3.12e Accessory building sales do not matter. What about retail sales? Section 3.13 What is the intent of this section? Section 3.14 Remove "or sleeping" Section 3.15b Add snakes? Section 3.16 Would like copies of other zoning ordinance with similar lake frontage that address front vs. back yard, accessory buildings, building heights, fencing, boats, and portable docks. 2000-33 VARIANCE REQUEST - 926 LAKE AVENUE Linda Ahlstedt, neighbor to 926 Lake Avenue, was concerned about the recent denial of a variance request at 926 Lake Avenue. She stated concerns about the noise of the pump if there is no pool house. The Planning Commission explained their reasons and stated that she should call the police and issue a complaint under the noise ordinance if it becomes a problem. Meeting adjourned at 8:00 p.m. ___________________________________ Ann Marie Cummings, CMC City Clerk MINUTES OF THE REGULAR MEETING OF THE PLANNING COMMISSION OF THE CITY OF NORTH MUSKEGON November 8, 2000 The meeting was called to order at 6:00 p.m. COMMISSIONERS PRESENT Vern Molitor, Tracy Sodini, Donna Spytma, Steven Szatkowski, Harry Wierenga, Kenneth Winter, and Chris Witham.(7) COMMISSIONERS ABSENT Roger Buter and Roy Walters.(2) 2000-28 APPROVAL OF MINUTES - AUGUST 9, 2000, AUGUST 29, 2000, AND SEPTEMBER 25, 2000 Sodini moved, Witham seconded, to approve the minutes of August 9, 2000, August 29, 2000, and September 25, 2000 as presented. MOTION CARRIED. 2000-29 LOT SPLIT - 436 OAKNOLL Mr. Stephen Vallier of Westshore Consulting presented a proposal to split the lot at 436 Oaknoll on behalf of Mr. Mike Lonnee. A copy of the proposed lot split is on file in the Clerk’s Office. If the new lot were built on, it would not be able to hook up to City water at this time. A well would be required. The new owner stated that he did not have any plans to develop the proposed lot at this time. Wierenga moved, Winter seconded, to approve the lot split as proposed. Ayes: Commissioners Winter, Szatkowski, Spytma, Wierenga, and Sodini.(5) Nays: Commissioners Molitor and Witham. (2) MOTION CARRIED. 2000-30 HOME OCCUPATION REQUEST - 2218 MILLS Sodini moved, Witham seconded, to approve the home occupation request for Rebecca VanderStelt at 2218 Mills for use as a part-time hair salon. MOTION CARRIED. 2000-31 PUBLIC HEARING - HOME OCCUPATION PERMITS This is the annual review of Home Occupation Permits. No public comments were received. No action was taken. MOTION CARRIED. 2000-24 VARIANCE REQUEST - 926 LAKE AVENUE Michelle Dalton, 926 Lake Avenue, is requesting a variance of a side yard set back from eight (8) feet to three (3) feet to build a 10x8 barn. Michael Godinez, 914 Lake Avenue, stated that there is a lack of consistency with enforcement of the ordinance and stated that he was against the project. A letter was received from Ms. Ahlstedt, 922 Lake Avenue, stating that she was in favor of the variance. A long discussion ensued amongst the Planning Commissioners. Buter moved, Szatkowski seconded, to approve the variance as requested at 926 Lake Avenue based on the proximity of the home and the noise of the pumps. Ayes: Commissioners Buter, Szatkowski, Spytma, and Sodini. Nays: Commissioners Walters and Witham. MOTION CARRIED. 2000-25 PROPERTY AT CENTER AND RUDDIMANTim Westra has purchased the Sherburn Garage property. He presented a concept to place condominiums on the property. The Planning Commission stated that traffic issues would be a concern in that area. A formal plan may be presented at a later date. NO ACTION TAKEN. MOTION CARRIED. 2000-17 DISCUSSION OF CURRENT ORDINANCE - PAUL M. LEBLANCAttached are several items reviewed by Paul LeBlanc of Langworthy, Strader, LeBlanc & Associates, Inc. The Planning Commission spent a great deal of time speaking of many of these items at length. They will resume the discussion at the next Planning Commission Meeting scheduled for July 12, 2000. MOTION CARRIED. 2000-14 HOME OCCUPATION LICENSE - 402 E. CIRCLERene’ Webster, 402 E. Circle, is seeking a home occupation license to maintain a website business at her residence. There will be no additional traffic or signage. Witham moved, Winter seconded, to approve a home occupation license at 402 E. Circle as presented. MOTION CARRIED. 2000-15 MODIFIED SITE PLAN - BEAR CREEK CONDOS Steve Vallier, of Westshore Engineering, presented the modified site plan proposing single unit condominiums. The Planning Commission clarified that individual variances would have to be sought for each unit and brought before the Commission if needed. Witham moved, Winter seconded, to approve the modified site plan as presented for proposed single units. Commissioner Wierenga abstained. MOTION CARRIED. MOTION CARRIED. 2000-10 VARIANCE REQUEST - 322 WATERVIEW LANEWilliam Ginman, Jr., 17680 Spahr Street, Spring Lake, MI, is requesting a variance at 322 Waterview of a front yard variance from 25 feet to 10 feet and a rear yard variance from 30 feet to 6 feet to build a new home on the existing lot. Mr. Ginman gave an overview of the project. Ms. Paula Meyers, 326 Waterview Lane, stated that she felt more comfortable with the smaller size of the home proposed to be built. Ms. Marilyn Hoekema, 326 Ruddiman, stated that the City will have to find another area to plow the snow to. Molitor moved, Winter seconded, to close the hearing. MOTION CARRIED. Sodini moved, Winter seconded, to recommend approval to Council approval of the variance stating the peculiarness of the lot and that the house not be set plus or minus ten (10) feet of the house next door. MOTION CARRIED. 2000-11 VARIANCE REQUEST - 2005 LAKE AVENUE Kris Anderson, 2005 Lake Avenue, is requesting to add an addition of eight feet to the east side of the existing garage which is less than ten feet from the building. Mr. Anderson gave an overview of the project. Molitor moved, Sodini seconded, to close the public hearing. MOTION CARRIED. Molitor moved, Walter seconded, to recommend approval to the City Council with the contingency that the roof line remain the same pitch as the existing garage. MOTION CARRIED. 2000-12 VARIANCE REQUEST - 2305 RUDDIMAN DRIVE Charles Maciejewski, 2305 Ruddiman Drive, is requesting to extend the corner of his proposed addition into the eight foot setback on the side yard be approximately two feet. Mr. Maciejewski gave an overview of the project. Winter moved, Molitor seconded, to close the public hearing. MOTION CARRIED. Sodini moved, Water seconded, to recommend to City Council approval of the variance as proposed. MOTION CARRIED. MOTION CARRIED. 2000-7 NORTH MUSKEGON SPORTS COMPLEX - SITE PLAN REVIEW Dave Cooke presented a plan to build a new sports complex at the North Muskegon football field that will hold locker rooms and shower facilities. Witham moved, Walters seconded, to approve the site plan for a new sports complex at the North Muskegon football field as presented. 2000-8 REQUEST FOR LOT SPLIT - 322 WATERVIEW LANE This is a request to split the northerly 25 feet of a 198' x 66' vacant lot with an address of 322 Water view Lane. Molitor moved, Walters seconded, to approve the lot split at 322 Waterview Lane as presented. MOTION CARRIED. Stepke. 2000-1 APPROVAL OF MINUTES - DECEMBER 8, 1999 Szatkowski moved, Witham seconded, to approve the Planning Commission minutes of December 8, 1999 as presented. MOTION CARRIED. 2000-2 PRESENTATION Mayor Freeman presented Richard Wilson and Gary Britton with aerial photos of the City of North Muskegon for their years of service serving on the Planning Commission. (Chairman Spytma arrived 7:04 p.m.) 2000-3 SIGN PERMIT - FAMILY DOLLAR Allen Industries, Inc. is requesting to replace the face on the existing sign at 500 Whitehall Road that is currently 60 square feet on both sides. A representative of Family Dollar gave an explanation. Kennedy moved, Buter seconded, to recommend approval to Council to replace the face on the existing sign at 500 Whitehall Road as presented. MOTION CARRIED. 2000-4 SIGN PERMIT - TOUCHED BY THE LIGHT GALLERY Debra Yonkers, owner of Touched by the Light Gallery, 702 Holton Road, is requesting a sign variance to place a sign approximately 6 3/4 ft tall. Ms. Yonkers gave an explanation. Witham moved, Molitor seconded, to recommend approval of the sign variance to Council as presented. MOTION CARRIED. 2000-5 VARIANCE REQUEST - 430 MID OAK Lawrence Mallon, 430 Mid Oak Drive, is requesting a variance to extend his garage from eighteen (18) feet to twenty-one (21) feet toward the water, sewer, and utility line leaving a distance of five (5) feet between the garage and the line. Mr. Mallon was present and gave an explanation. Staff expressed their displeasure in expanding the garage stating if the water line were to break, the garage would likely be damaged in the process of getting equipment in the area. Mr. Mallon is aware of the possible danger and would like to proceed. Molitor moved, Szatkowski seconded, to recommend approval to Council the variance request at 430 Mid Oak as presented. Ayes: Kennedy, Molitor, Spytma, Szatkowski, Witham, and Kenneth Winter.(6) Nays: Buter. (1) MOTION CARRIED.
